Niagara Falls Getaway Rules & Regulations

  1. Contest Sponsor - Niagara Falls Tourism, and any of its Members and Partners involved in the Getaway Prize(s).

  3. To enter, complete the official on-line entry form at www.NiagaraFallsTourism.com. 4 draws will occur between June 1, 2006 to March 31, 2007. The first day thru the last day of the given month is considered the "Contest Period". The period of all Getaway is from June 1, 2006 to March 31, 2007 and is considered "The Promotional Period". Only one entry per person will be accepted during the entire Promotional Period. In the event it is discovered that you attempted to enter more than once during the Promotional Period, all your entries will be void. Entries for each of the 4 draws must be received by 11:59:59 p.m. on the day prior to the scheduled draw date. All eligible entries received by Contest Closing Date will be eligible for the draw held on the 1st day of June, September & December 2006 and March 1st , 2007 Sponsor will not be responsible for late, lost, misdirected or destroyed entries.
  4. Prize - There will be a total of FOUR Prizes available to be won. Each of the FOUR - Family of 4 prizes consists of a 1 night stay in a minimum of a Standard Room at a Niagara Falls Hotel based on occupancy for a Family of 4. Actual hotel reservation will be made directly by Niagara Falls Tourism. Winner is to contact the Niagara Falls Tourism Office with potential dates of arrival convenient to him/her, and will be subject to availability, and any applicable blackout periods. Limit of one prize per person / one email address allowed. Valid dates for the Prize/hotel reservation are noted on the contest page. Approximate retail value of the Prize package will vary by hotel and by date. Approximate average value of each prize is $1500.00 Canadian. Prize winners and family will be responsible for obtaining any required travel and health documents, and are responsible for all gratuities, incidentals, and all other expenses not specifically mentioned above. Odds of winning depend on the number of eligible entries received during the contest period. For US residents any income tax on the prize is the sole responsibility of the winner and both the winner and their family must be able to legally travel to and/or within Canada. Travel arrangements are the responsibility of the winner and are not included in the Prize value.

Random Draws - A total of 4 random draws will be conducted by the Niagara Falls Tourism staff at the 1st day of June, September and December, 2006 and March 1st, 2007 at approximately 4:00 p.m. from all eligible entries received within the relevant Contest Period to award the FOUR Prizes. All selected entrants will be contacted by email, telephone, mail or courier. Sponsor is not responsible for any entrant's change of email, mailing address or telephone number. In order to win, the selected entrants. All entries must be eligible according to the official rules. In the event a selected entrant cannot be contacted within 5 DAYS of prize notification, or if any prize notification is returned as undeliverable, another selected entrant will be chosen for the appropriate month. The winners and the Family agree to release Sponsor form any and all liability for any and all damages related to or resulting from the Getaway or awarded Prizes.
  6. Eligibility -Must be at least 18 years of age and a legal resident of Canada. Contest is open to all legal residents of the United States 21 years of age or older at the contest start date. Contest excludes employees (and persons with whom they are domiciled) of the Contest Sponsor, their advertising and promotional agencies and its Members and Partners. This contest is subject to all applicable Federal, Provincial, Municipal and State laws and regulations. All decisions of the independent contest judging organization are final and the Contest Sponsor shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the contest. The Contest Sponsor reserves the right to modify, amend or terminate this contest with no obligation or liability if due to fraud, virus, bugs or other causes beyond the control of Sponsor or the administration, security or proper play of the game, subject to applicable law.   7. Prizes Awarded must be accepted as awarded and are non-refundable, non-transferable and are not convertible to cash. The Contest Sponsor reserves the right to substitute a Prize or any portion thereof with one of equal or greater value. No correspondence will be entered into except with the selected entrants. By entering this contest and accepting a Prize, the entrants consent to the use of their name, city of residence, video image, quotes and/or photograph in any related publicity or Internet posting without compensation, except where prohibited.
  8. All entries become the Property of the Contest Sponsor upon receipt and will not be returned. No responsibility will be taken for any failure of the web site during the promotion or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any on-line Internet entry to be received by the Contest Sponsor due to technical problems or traffic congestion on the Internet or at any web site, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately alter or damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor, reserves the right to seek remedies and damages to the fullest extent permitted by law - including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entries that are inaudible or unintelligible will be disqualified. Sponsor assumes no responsibility for human or technical error in the transmission or receipt of phone entries. The winners release the Contest Sponsor, their directors, employees, officers and agents, including without limitation their advertising and promotion agencies, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, including any travel related thereto.
  9. Disputes -- In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder" person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in the Eligibility section of these Official Rules. "Authorized Holder" shall mean the natural person assigned to an email address, by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process.
